This Legal Notice sets out the Grand Emporium's copyright and trademark positions, describes the intellectual property rights of the brands whose collections we distribute, and explains how to report infringement or notify us of allegedly infringing content on our store.

The Grand Emporium as Distributor

The Grand Emporium is a distribution house. We bring exceptional collections to market and manage the full customer experience on behalf of the brands we carry. Intellectual property rights in the collections and products available through our store — including the designs, garments, graphics, names, and associated creative work — belong to the respective brand, not to the Grand Emporium.

The Grand Emporium is authorised by the brands it carries to distribute their collections and to act on their behalf in matters relating to the sale and customer-facing presentation of their work through our store. Each brand retains full and independent intellectual property rights and may enforce those rights directly at their discretion.

Copyright

Content owned by the Grand Emporium. All material on our store that is not part of a brand's collection — including the store's design, layout, copy, photography, branding, and the selection and arrangement of these elements — is the copyrighted property of the Grand Emporium or its licensors.

Content owned by the brands. The collections and products distributed through our store — including garment designs, graphics, prints, text, imagery, and the creative work embodied in each piece — are the copyrighted property of their respective brand owners.

All copyrighted material is protected under applicable copyright law and international copyright treaties including the Berne Convention.

No part of any copyrighted material may be reproduced, distributed, transmitted, displayed, published, broadcast, modified, sold, sublicensed, or used to create derivative works, in any form or by any means, without the prior written permission of the relevant copyright holder, except as permitted by applicable law.

Trademarks

Trademarks of the Grand Emporium. The following is a trademark of the Grand Emporium:

The Grand Emporium

This name, together with its associated logos, taglines, designs, and slogans, is a trademark of the Grand Emporium, whether registered or unregistered, and is protected under applicable trademark law and international trademark treaties. Unauthorised use — including in domain names, social media handles, product names, advertising, or any commercial context — is prohibited.

Trademarks of the brands. The collections carried by the Grand Emporium are sold under the trademarks of their respective brand owners. Those marks remain the exclusive property of the relevant brand. The Grand Emporium makes no claim of ownership over any brand trademark. Any unauthorised use of a brand's trademarks should be reported directly to that brand or to us at legal@thegrandemporium.com and we will pass the report to the relevant party.

All other names, logos, and trademarks appearing on our store are the property of their respective owners and are used for identification purposes only.

Reporting Infringement

If you become aware of any unauthorised use of the Grand Emporium's trademarks or copyrighted store content — including impersonating accounts, unauthorised use of our name or branding, or reproduction of our store's creative assets — please report it to us at legal@thegrandemporium.com.

If you become aware of any unauthorised use of a brand's collection — including counterfeit products, unauthorised reproductions, or pirated design assets — please also report it to us at legal@thegrandemporium.com. We will investigate and pass the report to the relevant brand.

Please include in your report:

A description of the trademark or copyrighted work being infringed.

The URL, platform, or location where the infringement appears.

Any supporting evidence including screenshots, links, or account names.

Your name and contact information.

Notice-and-Takedown Procedure for Content on Our Store

If you are a copyright owner, or are authorised to act on behalf of one, and you believe that content available on the Grand Emporium infringes your copyright, please send a written notice to legal@thegrandemporium.com.

To be valid, your notice must include all of the following:

Identification of the copyrighted work that you claim has been infringed. If multiple works are involved, a representative list will suffice.

Identification of the allegedly infringing material, including the URL, page, or product where it appears on our store, with enough detail to enable us to locate it.

Your contact information, including your full name, postal address, telephone number, and email address.

A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.

A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

A physical or electronic signature of the copyright owner or the person authorised to act on their behalf.

This procedure complies with the takedown notice requirements of the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and is consistent with the notice provisions of the Copyright Act of the Federal Republic of Nigeria (Cap. C28, Laws of the Federation of Nigeria 2004, as amended), the European Union Digital Services Act (Regulation (EU) 2022/2065), and the United Kingdom Copyright, Designs and Patents Act 1988.

Upon receipt of a valid notice, we will:

Acknowledge receipt within five business days.

Investigate the claim promptly, in consultation with the relevant brand where applicable.

Remove or disable access to the allegedly infringing material if the notice is valid, or explain our position if we believe the use is lawful.

Notify the user or party responsible for the material, where appropriate, of the takedown.

Counter-notice. If material you posted has been removed in response to a takedown notice and you believe the removal was a mistake or that you have the right to use the material, you may submit a counter-notice to legal@thegrandemporium.com containing the same elements as above, together with a statement under penalty of perjury that the material was removed as a result of mistake or misidentification.

Repeat infringers. Accounts that are the subject of repeated valid infringement notices may be terminated at our discretion.

Misrepresentation. Submitting a knowingly false takedown notice or counter-notice may result in legal liability. We reserve the right to pursue claims against parties who misuse this procedure.

Limitation of This Notice

This Legal Notice supplements but does not replace the intellectual property provisions in our Terms of Service. In the event of any conflict between this Notice and the Terms of Service, the Terms of Service control.
